Ballot Access News: Upcoming Special Congressional Election Already has Poll Results, Even Before Election has been Announced

"Separate polls released Tuesday indicate the as-yet-unofficial contest to replace retiring [California State] Representative Jane Harman (Democrat-Venice) could be a neck-and-neck race between two prominent Democratic women — California Secretary of State Debra Bowen and Los Angeles City Councilwoman Janice Hahn. ...Campaigns typically use favorable results of polls, whether their own or others', to gin up support and raise money."

Campaigns for this special election have already commenced, even though current California State Rep. Harman is still in office.  Is this right?


According to an article in Ballot Access News,
"Although California Congresswoman Jane Harman is expected to resign her seat on February 28, no one may even start to file papers to run in the special election until she does resign. However, polls are already being commissioned to measure the voter appeal of two candidates expected to run in the special election, Janice Hahn and Debra Bowen."
